2.6.1. “Enence” instant translator device is an electronic device (hereinafter - “Enence Device”) designed to be used as a real-time voice translator which could translate words and sentences that a User would articulate and express audibly to the device and the device would translate the articulated words and sentences into another language of the User’s preference.

2.6.2. In order to use the Enence Device, You will be required to download and install an app (hereinafter - “Enence App”) on a smartphone or other smart device that has both Bluetooth and internet connectivity. Connecting an Enence Device to a smart device with internet access is necessary to deliver instant, real-time translations unless language packs are downloaded from the Enence App. If language packs are downloaded, the Enence Device can operate in offline mode for certain languages, but it still requires a Bluetooth connection to that smart device.

2.6.3. Please note that if You use the Enence Device without downloading language packs from the Enence App to Your smart device, You will require an internet connection, which might incur additional fees from Your broadband service provider due to the use of the internet.

2.6.4. Enence Device is an electronic device containing a lithium battery, so it will require charging from time to time. The Enence Device’s battery life will be dependable on the intensity of the use of the device. Together with the Enence Device, You will receive a USB cable for charging the device. Please note that the use of other, than the one provided with Enence Device, charging cables might result in a battery failure or decreased battery life.

2.7 Key features of Enence App & Rules of Use

2.7.1. The Enence App consists of two core features:

2.7.1.1. Enence Translator – a translation service designed for exclusive use with the Enence Device, providing Users with access to downloadable language packs. The Enence Translator is offered free of charge and does not require User’s registration. Certain language packs, as specified on Our Website, may be used in offline mode once they have been downloaded using the Enence App; however, an internet connection is required for the initial download of any language pack, for the installation of updates to offline language packs, and for the downloading and use of language packs that do not support offline mode.

2.7.1.2. Enence Travel Buddy – a subscription-based travel assistance service available to Users who have paid the applicable subscription fee and that does not require User registration. The service is powered by an automation-based system that assists Users in preparing and organizing travel plans. Its functionality includes, but is not limited to, the creation of personalized itineraries and the provision of tailored suggestions for activities, tourist attractions, and other travel-related services based on the User’s preferences and input. The Enence Travel Buddy feature requires an active and stable internet connection at all times in order to function.

2.7.2. The User acknowledges and agrees that any costs, fees, or data charges arising from internet usage are determined by the User’s telecommunications service provider and remain solely the User’s responsibility.

2.7.3. The Enence Travel Buddy is powered by the Gemini, a family of advanced multimodal models provided by Google, LLC (hereinafter “Google”). While functionalities of the Enence Travel Buddy are enabled by Google’s technology, We do not control and cannot guarantee the continuous availability or absolute accuracy of outputs generated by Gemini, as these depend on factors outside Our direct control (including Your smart device, internet connection, and third-party systems). Accordingly, You should not rely solely on automated recommendations for decisions that could affect Your safety, finances, legal rights, or other significant matters, and You remain responsible for verifying such outputs before acting on them. We disclaim to the fullest extent permitted by applicable law liability arising from or related to the use, non-use, or malfunction of the Enence Travel Buddy service, including any reliance placed on its automated recommendations.

2.7.4. By downloading and/or using the Enence App, You agree to the following:

2.7.4.1. You must be at least 18 years of age.

2.7.4.2. You may use the Enence App and its features solely for lawful purposes and in accordance with these Terms of Service.

2.7.4.3. You must not reverse-engineer, decompile, modify, or otherwise tamper with the Enence App or its components.

2.7.4.4. You must not use the Enence App in any manner that could damage, disable, overburden, impair, or interfere with its functionality, security, or interoperability, or that disrupts other Users’ access. This includes prohibitions on automated querying, scraping, and providing malicious input intended to mislead or compromise outputs generated by the Enence Travel Buddy.

2.7.4.5. You must respect intellectual property rights, including copyrights, trademarks, database rights, trade secrets, and other proprietary notices displayed within the Enence App.

2.7.4.6. You must not use the Enence App to transmit harmful, unlawful, defamatory, obscene, or otherwise objectionable material. In particular, when using Enence Travel Buddy, You must not generate, distribute, or facilitate any content or activity that:

a) involves child sexual abuse or exploitation, violent extremism, terrorism, non-consensual intimate imagery, self-harm, or other illegal acts;

b) infringes the rights of others, including privacy, copyrights, trademarks, database rights, or biometric rights;

c) tracks, monitors, or makes high-risk automated decisions affecting individual rights without legally required consent or human oversight;

d) compromises the security, integrity, or availability of any services or infrastructure (including through spam, phishing, malware, interference, disruption, or circumvention of safety measures);

e) is sexually explicit, violent, hateful, harassing, or otherwise harmful; or

f) constitutes misinformation, misrepresentation, impersonation, deception, or fraudulent/misleading claims, including about expertise, governmental processes, health practices, or content origin.

2.7.4.7. You understand that the Enence Travel Buddy utilizes Google Gemini technology to provide You with personalized digital guide to travel. By using this feature, You agree to comply with all applicable terms of use, policies, and rules established by Google for the use of Gemini, as may be updated from time to time (https://policies.google.com/terms).

2.7.5. We reserve the right to suspend or terminate a User’s access to the Enence App, in whole or in part, if the User violates these Rules of Use or engages in conduct that We reasonably determine to be harmful to the Enence App, its Users, or any third party.

2.8. Accessories of the Enence Device

2.8.1. You can also buy accessories for the Enence Device on Our Website, such as Universal charger travel adapter, Travel accessories organizer, Micro USB charging cables, Language learning app, and other. From time to time We might offer other accessories or limited edition products.

2.8.2. All of the Enence Device accessories sold on the Website are compatible with an Enence Device. Please note that the use of other accessories that You purchase from other vendors may not be compatible with Enence Device and even damage Your Enence Device irreparably. Please note that You may lose Your Enence Device warranty if it gets damaged due to the use of third party accessories (such as chargers).

6. POVRAĆAJ I REFUNDACIJA
